1. PALVELU / SERVICE

Kirjautuessasi palveluun joudut hyväksymään nämä käyttöehdot. Korkeakoululla on oikeus muuttaa näitä ehtoja.

At logging in to the Service, you will have agree to the Terms of Use. The University has the right to change these terms and conditions.

1.1 Palvelun toiminta / Service operation

Korkeakoulu vastaa palvelun teknisestä toiminnasta, luotettavuudesta ja käytettävyydestä parhaansa mukaan. Korkeakoulu ei kuitenkaan takaa keskeytyksetöntä ja virheetöntä palvelua. Korkeakoululla on oikeus keskeyttää palvelun toiminta esimerkiksi korjaus-, päivitys-, tai muun ylläpidollisen toiminnon takia, ja mikäli lait, säädökset tai viranomaiset niin edellyttävät. Korkeakoulu ei vastaa virheellisistä tai kadonneista aineistoista, eikä käyttäjän lataamien aineistojen varmuuskopioinnista, tämä ei kuitenkaan poissulje mahdollisia automaattisia varmuuskopioita palvelun ylläpidon puitteissa.

Korkeakoulu vastaa palvelun toimivuudesta, kun sitä käytetään korkeakoulun tiloissa tai korkeakoulun työvälineillä. Korkeakoulu ei vastaa ongelmista, jotka syntyvät käyttäjän omien henkilökohtaisten työvälineiden käytöstä.

Palvelun käyttäjä ei saa aiheuttaa haittaa tai vahinkoa muille käyttäjille, tietojärjestelmille tai palvelun piirissä oleville organisaatioille.

The University shall be responsible for the technical operation, reliability and availability of the Service to the best of its ability. However, the University does not guarantee uninterrupted and error free service. The University has the right to suspend the Service, for example due to repair, updating or other maintenance, and if required by law, regulation or authority. The University shall not be responsible for any inaccurate material or lost material, nor for the back-up of user-uploaded material, however, this does not exclude the possibility of automatic backups as part of the Service maintenance.

The University responsible for the functionality of the Service when used on the school premises or in the school equipment. The University is not responsible for any problems arising from the use of the user's own personal tools.

The user of the Service must not cause harm or damage to other users, information systems or organizations within the Service.

1.2 Käyttöoikeus ja tunnukset / Rights of use and user accounts

Kaikilla käyttöön oikeutetuilla on mahdollisuus kohtuulliseen ja asialliseen palvelun käyttöön. Käyttöoikeus syntyy opiskelu- tai työsuhteen kautta, tai muuten opetuksellisten tarpeiden nojalla esimerkiksi ulkopuoliset luennoitsijat.

Palvelun käyttäjätunnus ja salasana ovat henkilökohtaisia, eikä niitä saa luovuttaa tai muulla tavoin siirtää toiselle henkilölle. Palvelun käyttäjä vastaa tunnuksen ja salasanan huolellisesta säilyttämisestä. Mikäli epäilet käyttäjätunnuksen/salasanan joutuneet toisen henkilön käsiin, olet velvoitettu ilmoittamaan siitä viipymättä LUT korkeakoulujen IT-palveluihin.

Palvelun käyttäjäoikeutesi on voimassa vain sen ajan, kun opiskelu- tai käyttöoikeus tai työsopimus on voimassa korkeakoulussa. Kun käyttäjä valmistuu, eroaa itse, erotetaan, keskeyttää opintonsa, eroaa korkeakoulun palveluksesta tai muuten käyttöperuste päättyy, päättyy samalla pääsy palveluun.

Palvelun paikallisten tunnusten voimassaolo on automaattisesti vuoden tai seuraavan lukuvuoden loppuun, mikäli muuta ei sovita.

Anyone entitled to use the Service can use the service reasonably. Access is created through a study or employment relationship, or otherwise based on educational needs, such as external lecturers.

The username and password for the Service are personal and may not be given or otherwise transferred to another person. The user of the Service is responsible for the careful storage of the username and password. If you suspect that your username / password has fallen into the hands of another person, you are obliged to report it immediately to your University’s IT Services.

Your right of use of the Service is only valid for the duration of your study, employment contract or access right. When the user graduates, resigns, is dismissed, terminates his or her studies, leaves the University, or otherwise user ID expires, terminates access to the Service at the same time.

Local accounts of the Service are automatically valid until the end of the year or the following academic year, unless otherwise agreed.

2. Opiskelijan oikeudet ja velvollisuudet / Rights and obligations of the student

Palvelussa jaettu oppimateriaali tai aineisto on Suomen tekijänoikeuslainsäädännön alaista ja on jaettu vain opiskelukäyttöön opetusalan digiluvan perusteella. Opiskelijalla on oikeus tallentaa tai tulostaa opiskelussaan tarvitsemaansa aineistoa vain omaan käyttöön. Aineistoa saa hyödyntää opiskeluun liittyvien tehtävien tekemisessä ja sen käytössä on noudatettava hyvän tavan mukaisia käytänteitä esimerkiksi käytetyn aineiston tekijän maininta. Joidenkin aineistojen hyödyntäminen osana omaa tuotosta voi vaatia erillisen luvan tai lisenssin.

Aineiston muokkaaminen, levittäminen, julkisesti saatavaksi tai julkinen esittäminen ilman tekijän lupaa on ehdottomasti kielletty. Creative Commons-lisensoitua materiaalia voi käyttää kyseisen lisenssin käyttöehtojen mukaisesti.

Aineiston mahdollisia tekijänoikeustietoja ei saa poistaa eikä niissä olevia luku-, tallennus- tai katselusuojauksia saa teknisesti kiertää.

Opiskelijan itse valmistama ja palveluun lataama materiaali on tekijänoikeuden mukaisesti hänen omistuksessaan, eikä sitä saa käyttää opetuksessa ilman lupaa pois lukien kuitenkin sellaiset opetukselliset tehtävät, joissa opiskelijan tuottamaa materiaalia jaetaan saman opintojakson opiskelijoille nähtäväksi, kommentoitavaksi tai arvioitavaksi.

Opiskelija vastaa itse tuodessaan palveluun teoksia tai materiaalia, ettei niiden käyttö riko muiden osapuolten tekijän- tai muita oikeuksia. Palvelun ei saa ladata loukkaavaa sisältöä tai muuta asiatonta materiaalia. Myöskään käyttäjä ei saa viestinnässä, sanallisesti, kuvallisesti tai kirjallisesti loukata millään tavalla muita yksilöitä tai yhteisöjä.

The educational material or other material distributed in the Service is subject to Finnish copyright laws and is provided for educational use only based on a Digital License for educational use. Students have the right to save or print the material they need for their studies, only for their personal use. The material may be used for study-related assignments and should be used in accordance with good practices, such as mentioning the author of the material used. Exploitation of certain materials as part of your own production may require separate permission or license.

Editing, distribution, making available to the public or displaying of the materials available in the Service is strictly forbidden without the author's permission. You may use Creative Commons licensed material subject to the terms of that license.

Any copyright information in the material must not be removed and any read, write, or viewing protection may not be technically circumvented.

The material produced by the student and uploaded to the service is the copyright of the student and may not be used in teaching without permission, except for teaching assignments where the student-produced material is distributed to students in the same course for viewing, commenting, or evaluating.

When submitting works or materials to the service, the student is responsible for not infringing the copyrights or other rights of other parties. You may not upload offensive content or other inappropriate material to the Service, nor may you offend other individuals or communities verbally, pictorially, or in writing.

3. Opettajan oikeudet ja velvollisuudet / Rights and obligations of the teacher

Lähtökohtaisesti opettajan tuottama aineisto on tekijänoikeuslainsäädännön alaista materiaalia, eikä sitä saa muut käyttää ilman erityistä lupaa. Sopimuksella kuitenkin opettaja voi antaa opiskelijalle tai korkeakoululle luvan käyttää aineistoa opetuksessa tai muussa tarkoituksessa. Opettaja ei saa luvatta käyttää toisen opettajan palvelussa olevaa materiaalia.

Opettaja on velvoitettu huolehtimaan palveluun lisäämänsä aineiston tekijänoikeudellisista seikoista korkeakoulun digiluvan puitteissa.

Palveluun ei saa ladata loukkaavaa sisältöä tai muuta asiatonta materiaalia, eikä myöskään käyttäjä saa sanallisesti, kuvallisesti tai kirjallisesti loukata muita yksilöitä tai yhteisöjä.

In principle, the material produced by the teacher is subject to copyright law and may not be used by others without specific permission. However, by agreement, the teacher may authorize the student or University to use the material for teaching or other purposes. Teacher may not use any material provided by another teacher without permission.

The teacher is obligated to take care of the copyright issues of the material he / she has added to the Service within the framework of the University's Digital License for education.

You may not upload offensive content or other inappropriate material to the Service, nor may you offend other individuals or communities verbally, pictorially, or in writing.

4. Tietosuoja, tietojenkeruu ja yksityisyys / Data protection, data collection and privacy

Palvelua käytettäessä kerätään käyttäjän toiminnasta erilaisia tietoja. Tietoja käsitellään lakien ja asetusten mukaisesti, mikä ilmenee tietosuojailmoituksista:

Yksityisyyden suojaa tulee kunnioittaa. Käytön tulee olla voimassa olevien säännösten mukaista ja eettisesti hyväksyttävää. Laittoman tai hyvän tavan vastaisen materiaalin julkaiseminen, välittäminen tai jakelu on kielletty. Ylläpitäjällä on oikeus poistaa tällainen materiaali ja estää käyttäjän pääsy palveluun, mikäli käyttäjä rikkoo käyttösääntöjä.

When using the Service, various information about the user's activity is collected. The information is processed in accordance with the laws and regulations as stated in the Privacy Noticies:

The protection of privacy must be respected. Use shall be in accordance with current regulations and ethically acceptable. It is forbidden to post, transmit or distribute material that is illegal or against good manners. The Administrator has the right to remove such material and prevent the user from accessing the Service in case the user violates the terms of use.

5. Arkistointi / Archieving

Jokainen käyttäjä vastaa itse omien materiaalien varmuuskopioinnosta.

Opintosuoritukset palvelussa säilytetään minimissään lain vaatiman ajan. Palvelussa olevien opintojaksot ja niiden aineistot sekä aktiviteetit poistetaan tietyn ilmoitetun ajan kuluttua.

Each user is responsible for backing up their own materials.

The completed assignments will be kept for a minimum period required by law. Courses in the Service and their materials and activities will be deleted after a specified period.
